SPECGRAPHIXEDU PRIVACY POLICY

Effective Date: 09/01/2021

    1.  INTRODUCTION. At BNSBC Media Ventures LLC (“BNSBC”) we know you care about how your personally identifiable information is used and shared, and we take your privacy seriously.  Please read the following to learn more about our Privacy Policy (the “Policy”) for SpecGraphixEDU.  By using or accessing the SpecGraphixEDU Platform in any manner, you acknowledge that you accept the practices and policies outlined in this Policy, and you hereby consent that we will collect, use, and share your information in the following ways.  Any capitalized terms that are not defined in this Policy are defined in our Terms of Service. 

    2. CHILDREN’S PRIVACY.  The SpecGraphixEDU Platform is specifically geared towards children under the age of 13. In accordance with the Children’s Online Privacy Protection Act (“COPPA”), this Policy explains what information we collect from minors and their Guardians (Section 3), how we use that information (Section 4), the limited circumstances under which we may disclose information that we collect (Section 5), and other key information about our information collection practices, such as our process for obtaining Guardian consent before we knowingly collect personally identifiable information online from children who are under 13 (Section 2.2).

        2.1 Acceptance of Terms and Policy. As stated in the Terms, if you are a Guardian of a Student, you must accept the Terms (which include this Policy) on behalf of yourself and on behalf of the Student.

        2.2 Guardian Consent. We do not knowingly collect or solicit personally identifiable information from a child under 13 without obtaining verifiable consent from that child’s Guardian (“Guardian Consent”), except for the limited amount of personally identifiable information we need to collect in order to obtain Guardian Consent (“Required Information”). If you are a Guardian of a Student, we will obtain your Guardian Consent by asking you to make a small, nominal payment with your debit or credit card. 

 

Until we have received Guardian Consent, we will only use Required Information for the purpose of obtaining Guardian Consent. If you are a child under 13, please do not attempt to send any personal information about yourself to us before we obtain Guardian Consent, except for the Required Information in the context of the Guardian Consent process. 

 

If you believe that a child under 13 has provided us with personal information (beyond the Required Information) without our obtaining Parental Consent, please contact us at info@bnsbc.tv.  

    3.  INFORMATION COLLECTED. 

       

        3.1 Voluntarily Disclosed Information. When you use the SpecGraphixEDU Platform, you will have the opportunity to provide us with some information directly. This section identifies those opportunities and the specific information that will be collected. 

        3.1.1 Account Registration. You will be asked for the following information so that you can register for an account and build your profile on the SpecGraphixEDU Platform:

        - Student name

        - Student username

        - Student location

        - Student demographic information

        - Student picture

        - Student usernames for third party platforms that are discussed in Classes

        - Guardian email address

        - Guardian phone number

        3.1.2 Class Meetings. Student usernames, voices, and faces will be observable at each virtual meeting so that each Student can take part in the meeting and interact with other Students. As a Guardian, if you do not want your child’s image or voice to be transmitted during virtual meetings, please ensure that your child’s camera and microphone remain off. For meetings that occur in person (if any), the hosting organization will provide an explanation of its information collection practices. 

        3.1.3 User Content. Certain parts of the SpecGraphixEDU Platform also allow you to upload or post User Content. Please note that any User Content you post may be viewable to other Students in your Class. For example, if you upload a project to the SpecGraphixEDU Platform, it will be viewable by other Students in the Class. BNSBC recommends that you do not post any sensitive personally identifiable information in your User Content, such as your address, information about website accounts, credit card numbers, or your Social Security Number, as that information may be seen by others. Additionally, as a Guardian if you do not want your child’s User Content to be shared with other Students, you must contact BNSBC to request that your child’s work is not shared through our services (e.g., such as through screen sharing on Zoom). 

        3.1.4 Financial Information. If you are a Guardian, you will be asked to provide certain financial information so that you can be charged for the Class(es) that you have purchased for your child. Please note that your financial information will be collected by a third-party payment processor that we have engaged to handle our financial transactions, and we will not have access to your financial information.

    3.2 Automatically Collected Information. 

       

        3.2.1 Browser & Device Information. Whenever you interact with the SpecGraphixEDU Platform, we automatically receive and record information on our server logs from your browser or device, which may include your IP address, geolocation data, device identification, “cookie” information, the type of device you’re using to access the SpecGraphixEDU Platform, the amount of time spent on the SpecGraphixEDU Platform, and the page or feature you requested. “Cookies” are identifiers we transfer to your browser or device that allow us to recognize your browser or device and tell us how and when pages and features in the SpecGraphixEDU Platform are visited and by how many people.  You may be able to change the preferences on your browser or device to prevent or limit your device’s acceptance of cookies, but this may prevent you from taking advantage of some of our features.  

        3.2.2 Emails. We may receive a confirmation when you open an email from us. 

    3.3 Minimization of Collected Information. We do not condition participation in the SpecGraphixEDU Platform on disclosure of more personal information from Students than is reasonably necessary for that participation, and we do not retain personal information from Students longer than is reasonably necessary in order to fulfill the purpose for which it was disclosed.

    4. USE OF COLLECTED INFORMATION. 

       

        4.1 Student Personal Information. After obtaining “Guardian Consent” we may use Student information in the following ways:

        4.1.1 Class Registration and Meetings. BNSBC uses the Student information listed in Section 3 to register Students for Classes and operate those Classes. BNSBC will also use Student contact information in order to communicate directly with Students and to enable Students to communicate with each other.

        4.1.2 Meeting Recordings. In the event that it is necessary, meetings may be recorded, and the information listed in Section 3.1.2 will be part of such Meeting Recordings. As explained in our Terms, Meeting Recordings will be accessible to other Students in the relevant Class upon request for a limited period of time. 

        4.2 Guardian Information. BNSBC uses Guardian information to obtain Guardian Consent, facilitate payments for Classes, for e-mail communications, and to facilitate communications between Guardians of Students in the same Class. 

        4.3 Emails. Information transmitted when you open an email from us helps us make our communications with you more interesting, helps us provide the most useful information to you, and improve the SpecGraphixEDU Platform.

        4.4 Usage Information. We may use the automatically collected information listed in Section 3.2 to customize content for you that we think you might like, based on your usage patterns.  We may also use it to improve the SpecGraphixEDU Platform – for example, this data can tell us how often users use a particular feature of the SpecGraphixEDU Platform, and we can use that knowledge to make the SpecGraphixEDU Platform interesting to as many users as possible. 

        5. DISCLOSURE OF INFORMATION. 

 

        5.1 Third Party Service Provider. We employ other companies and people to perform tasks on our behalf and need to share your information with them to provide products or services to you. We use the following platforms:

- Zoom: BNSBC uses Zoom to conduct class meetings for Students. 

- Wix: BNSBC collects visitor time and city for customer analytics.

- PayPal: Processes payments to BNSBC for Classes.

- Discord: BNSBC uses Discord to conduct class meetings for Students.

- Classkick: BNSBC uses Classkick services to post homework assignments for Students.

- Kahoot: BNSBC uses Kahoot to conduct interactive quizzes for Students.

- Peardeck: BNSBC uses Peardeck to conduct interactive slideshows for Students.

- Google Drive: BNSBC uses Google Drive to store Student files.

- Steam: BNSBC uses Steam to conduct various interactive activities using licensed software.

- Minecraft: BNSBC uses Minecraft to conduct class meetings and activities for Students.

- Scratch: BNSBC uses Scratch to teach coding to Students.

- Sketch.io (Sketchpad): BNSBC uses Sketchpad to teach graphic design to Students.

- Adobe Creative Cloud: BNSBC uses Adobe Creative Cloud to teach graphic design and media production to Students.

- WD MyCloud: BNSBC uses WD MyCloud to store Student files.

- Pencil2D: BNSBC uses Pencil2D to teach animation to Students.

- Amazon Web Services: BNSBC uses Amazon Web Services to store Student files and outsource online service processes.

- Microsoft Outlook: BNSBC uses Microsoft Outlook as a temporary email account for Students.

- Parsec: BNSBC uses Parsec to simulate software that requires computer hardware with high specifications on Student devices.

- YouTube: BNSBC uses YouTube to give Students access to video lectures outside of class time.

- Davinci Resolve: BNSBC uses Davinci Resolve to teach video editing to Students.

- WeVideo: BNSBC uses WeVideo to teach video editing to Students.

- Pixlr: BNSBC uses Pixlr to teach photo editing to Students.

- Google Ads: BNSBC uses Google Ads to advertise SGEDU services.

 

Unless we tell you differently, our agents do not have any right to use the personally identifiable information we share with them beyond what is necessary to assist us.         5.2 Public Information. Please note that if you submit any of your personally identifiable information to a portion of the SpecGraphixEDU Platform that is accessible by other users, including information that is shared at a Class meeting (visually, orally, or in writing), other Students will be able to see that personally identifiable information. Accordingly, only include information in such submissions and meetings that you are comfortable sharing with third parties. 

        5.3 Other Guardians. If you are a Guardian, we will make your email address available to Guardians of other Students in the Class to facilitate communications between Guardians.

        5.4 De-Identified and Aggregate Information. We may de-identify your personally identifiable information so that you are not identified as an individual and provide that information to our partners. We may also provide aggregate usage information to our partners, who may use such information to understand how often and in what ways people use the SpecGraphixEDU Platform, so that they, too, can provide you with an optimal online experience. However, we never disclose aggregate usage or de-identified information to a partner in a manner that would identify you as an individual person. 

        5.5 Business Transfers. We may choose to buy or sell assets and may share and/or transfer customer information in connection with the evaluation of and entry into such transactions. Also, if we (or our assets) are acquired, or if we go out of business, enter bankruptcy, or go through some other change of control, personally identifiable information could be one of the assets transferred to or acquired by a third party.

 

        5.6 Legal Compliance. We reserve the right to access, read, preserve, and disclose any information that we believe is necessary to comply with law or court order; enforce or apply our Terms of Service and other agreements; or protect the rights, property, or safety of BNSBC, the SpecGraphixEDU Platform, our employees, our users, or others.  

 

    6. SECURITY. 

 

        6.1 Disclaimer. We endeavor to protect the privacy of your account and other personally identifiable information we hold in our records, but unfortunately, we cannot guarantee complete security.  Unauthorized entry or use, hardware or software failure, and other factors, may compromise the security of user information at any time. 

        6.2 Meeting Recordings. Meeting Recordings will be password protected and available only to the Students in the Class for a limited period of time. Our Terms explain the situations in which a Student may request access to a Meeting Recording. 

        6.3 Student Information. We delete the personal information of Students when that information is no longer reasonably necessary to fulfill the purpose for collecting that information.

    7. MODIFICATION/DELETION OF INFORMATION. 

 

        7.1 If you are a Guardian of a Student of the SpecGraphixEDU Platform, you may contact us at any time to request (a) to view the type of personal information that is being kept, (b) we stop collecting personal information from the Student, (c) we delete any Personal Information already collected from the Student and from you, and (d) we stop disclosing Personal Information collected from the Student to third parties, but continue to allow for collection and use of Personal Information collected from the Student in connection with the SpecGraphixEDU Platform.

 

With respect to (d), please be aware that the collection and disclosure of a Student’s image, audio, and video are inherent in virtual meetings unless the Student’s camera and microphone are turned off. 

Please understand that, if you request removal of your information, you will be unable to utilize associated features of the SpecGraphixEDU Platform.  

 

        7.2 De-Identified and Anonymous Data. You may not request the removal of de-identified, anonymous, or aggregate data from our databases. You may not request the deletion of a Meeting Recording while we make the Meeting Recordings available to Students in the Class that have a reasonable need to view the Meeting Recording. However, if you request, we can blur the facial features of your child in that Meeting Recording. 

 

        7.3 Questions about Modification/Deletion of Information.  If you have any questions about viewing or updating information we have on file about you, please contact us at info@bnsbc.tv.

    8. CHANGES TO POLICY. 

 

        8.1 We’re constantly trying to improve the SpecGraphixEDU Platform, so we may need to change this Privacy Policy from time to time as well, but we will alert you to changes by placing a notice on our website and by sending you an email. Please note that if you’ve opted not to receive legal notice emails from us (or you haven’t provided us with your email address), those legal notices will still govern your use of the SpecGraphixEDU Platform, and you are still responsible for reading and understanding them. If you use the SpecGraphixEDU Platform after any changes to the Privacy Policy have been posted, that means you agree to all of the changes.
